Ontario Public Service Employees Union v Ontario (Training, Colleges and Universities), 2016 ONSC 6348

Facts:  The Applicant sought judicial review of a decision of the Grievance Settlement Board dismissing a grievance in which the grievor sought to hold her employer vicariously liable for the fact that a fellow employee had committed the tort of intrusion upon seclusion. The Application was dismissed by the court.
Significance: With respect to an employee's invasion of privacy, in this case the court found the employer not vicariously liable for an employee committing the "tort of intrusion upon seclusion" upon a co-worker.
