Issue Statement: March 25, 2014
Engineers are part of an interdisciplinary team that builds, creates, and maintains Canada’s infrastructure.
Legislation exists in Canadian provinces and territorials to govern construction liens. However, there are no consistent protections against delayed payments for contractors.
This can impact engineers both as providers of professional services, and as general contractors.
Engineers Canada therefore encourages all provinces and territories to examine the issue of prompt payment and consider appropriate legislation.
Quick Facts
- The majority of U.S. states, the European Union, United Kingdom, Ireland, Australia and New Zealand have prompt payment legislation in place.
- On May 13, 2013, Ontario Member of Parliament, Steven Del Duca (L), tabled a Private Members Bill entitled, An Act respecting payments made under contracts and subcontracts in the construction industry (Bill 69).
Next Steps
- Engineers Canada will continue to monitor the progress of Bill 69 in Ontario.
- Engineers Canada will liaise with the construction, consulting engineering, and other related sectors on the issue of prompt payment.
